1 INTRODUCTION
1.1 Fish Fight (“Fish Fight”) is owned and operated by KEO Films.com Ltd (“KEO”, “we”, “us” or “our” as appropriate). We may make Fish Fight available through a variety of channels. It is currently available through the website at www.fishfight.net (“Fish Fight Site”).
1.2 For the purpose of the Data Protection Act 1998, the data controller is KEO. For more information about KEO, please click here.
1.3 We are committed to safeguarding the privacy of users of Fish Fight. Please read the following Privacy Policy to understand how the information you provide is used and protected. If you have any queries or concerns regarding these practices, please contact us by emailing keo@keofilms.com.
1.4 Please note that by visiting and using Fish Fight you are agreeing to the use of your personal information as described in this Privacy Policy.
2 THE INFORMATION WE COLLECT AND HOW WE USE IT
2.1 The information we collect on Fish Fight and the way we use that information includes the following:
2.1.1 Your email address - this is not displayed publicly on Fish Fight. We use this information to communicate with you in connection with the campaign in which you have shown an interest and to reply to any emails that you send to us. We may also contact you about related marine conservation campaigns that we think you might be interested in, if you have opted to receive such emails;
2.1.2 Your name – your full name is not displayed publicly on Fish Fight unless you choose to use your full name as your user name and/or where you choose to sign the discard petition or take part in the public consultation on Marine Conservation Zones. If you sign the petition:• we will add your full name to the letter to be sent to Commissioner Maria Damanaki, Members of the European Parliament and all member state governments as part of the Fish Fight campaign; and• we will include your first name in a list of individuals who are supporting the campaign to show the amount of support the campaign has which will be displayed […]. If you take part in the public consultation on Marine Conservation Zonesyour name will be included in your e-mail to DEFRA;
2.1.3 Your user name - We ask that you provide a username by which you can be identified publicly. Please note that your username should not include your name or contain any other personal information that could be used to identify you (e.g. your address). If your username with Facebook (or any other authentication provider you can use to register with Fish Fight) contains personal information, we recommend that you do not use such third party facilities to sign up to Fish Fight and instead create a Fish Fight account in the standard way. Alternatively, if you do sign in through one of these third party facilities, then you can change your username in the ‘My account’ section of Fish Fight, after you have confirmed your registration. We also use your username to identify you in connection with ‘Join the Crew’, so for example, we include it in the personalised link we send you if you decide to sign up to ‘Join the Crew’ and in the ‘Join the Crew’ Leader Board. If you decide to share your personalised link with others via for example, Facebook or Twitter and they click on that link, then we track the URL used back to their registration, so that we can award you point(s) for their registration;
2.1.4 your photo – if you reach the rank of Skipper, then we invite you to upload your photo. If you do this, we use your photo to identify you on the Skipper’s Wall of Fame on Fish Fight;
2.1.5 Your friend’s e-mail address and name - if you choose to let us have your friend’s e-mail address and name, then we will use this to create a template e-mail to be sent to your friend, which we will invite you to complete, asking him/her whether they want to sign up to the campaign. We will not use it for any other purpose, unless your friend requests us to. Before you provide us with the name and e-mail address of your friend, please ensure you have asked them for their permission to disclose their details to us; and
2.1.6 Your country - this is not displayed publicly on Fish Fight but may be added to the letter to be sent to Commissioner Maria Damanaki, Members of the European Parliament and all member state governments. It may also be referenced against your first name, if you sign up to any Fish Fight campaign so that people can see how many people have signed up to the campaign and where they come from.
2.1.7 Your organisation – if you choose to disclose the name of your organisation when you take part in the public consultation for Marine Conservation Zones, the name of your organisation will be included in your e-mail to be sent to DEFRA.
3 HOW ELSE MAY WE USE YOUR PERSONAL INFORMATION?
3.1 We may use your personal information to investigate a breach of Fish Fight’s Terms of Use and to prevent and detect criminal activity, fraud and misuse of or damage to Fish Fight or the service made available through it and to prosecute those responsible.
4 INFORMATION SHARING AND DISCLOSURE
4.1 We do not sell or rent your personal information. We may, however, disclose information about you to the following, for the express purposes set out below:
4.1.1 to our employees and agents for them to administer any accounts or services provided to you through the Fish Fight. e.g. the sending of e-alerts or newsletters on our behalf;
4.1.2 if you sign up to our campaign, then we disclose your full name on the petition to be sent to Commissioner Maria Damanaki, Members of the European Parliament and all member state governments. We may also include your first name and the country in which you live in a list of individuals who are supporting the campaign and display this list in an LED counter and/or plasma screen in public places (including but not limited to outside the Houses of Parliament in Brussels and on the Fish Fight Site) to demonstrate the amount of support that has been generated for the campaign;
4.1.3 if you take part in the public consultation on Marine Conservation Zones, then your name, e-mail address and any personal information you include in your e-mail voicing your views on the marine conservation zones, are disclosed to DEFRA;
4.1.4 if you check the relevant box to permit communications from our closely related third party sites, such as River Cottage (rivercottage.net) or Channel 4, we will share your details with the parties that operate those sites, their employees and agents for them to send you their newsletters and other communications you sign up to. We advise you to review the Privacy Policies of those sites, so that you understand how they treat your personal information;
4.1.5 if you ‘Join the Crew’, then your username is used to identify you publicly on Fish Fight, as well as your photo (if you reach the rank of Skipper and choose to upload your photo to Fish Fight). In addition, if you share your personalised link (which includes your user name) on third party platforms (such as Facebook or Twitter) then each time you do so, your username is publicly disclosed (as part of that link) on those third party platforms;
4.1.6 Transfer of business: if there is a change (or prospective change) in the ownership of KEO or any of its assets, we may have to disclose personal information to the new (or prospective) owner. If we do so, we will require them to keep it confidential and use it in accordance with the terms of our Privacy Policy; and
4.1.7 Legal requests: Apart from the use and sharing of your personal information in the limited circumstances already described, the only ways we may share your information are if we need to disclose personal information to protect our and our licensors’ rights and property or to comply with any applicable law or valid legal process.
5.1 We may share non-personal aggregated statistics data about visitors to Fish Fight – including a counter of how many people are supporting the campaign. We may also share traffic patterns with third parties such as River Cottage (www.rivercottage.net). Just to be clear, this information does not identify users in any personal capacity; it just gives generalised information about the users of Fish Fight.

7.1 The Fish Fight Site contains links to third party websites that are not subject to this Privacy Policy. Please read the Terms of Use for further information on these links. We strongly recommend that you read the privacy policy of any such websites that you visit.
8 HOW DO WE PROTECT PERSONAL INFORMATION?
8.1 As required by the UK Data Protection laws, we follow strict security procedures in the storage and disclosure of information which you have given to us, to prevent unauthorised access. Despite this, we cannot guarantee the security of the information that you disclose to us. You accept the inherent risks of providing information and dealing on-line and will not hold us responsible for any breach of security unless this is due to our negligence or wilful default or failure to comply with our obligations under the UK Data Protection laws.

9 UNSUBSCRIBING FROM FISH FIGHT EMAILS
9.1 You can click the unsubscribe link included in an email to stop receiving e-alerts or newsletters from us.
10 ACCESSING AND UPDATING YOUR PERSONAL INFORMATION
10.1 Under the Data Protection Act you have the right to see the personal information that we hold about you, whether collected through your use of Fish Fight or through any communications that you have had with us. You will need to provide us with a written request and pay a small fee. If you have any queries about your right or wish to make such a request please contact us by email at keo@keofilms.com or by post addressed to the Data Protection Officer, 101 St John Street, London, EC1M 4AS.
10.2 You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by contacting us at the address provided in clause 13.1 or by clicking on the unsubscribe link included in any of these marketing messages.
10.3 If you wish to change your user name or photo, you can do so by clicking on ‘My Account’ at any time.
11 TRANSFER OF INFORMATION OUTSIDE EEA
11.1 Instances may occur when your personal information, in whole or in part, is transferred to, stored at, or processed at a destination outside the EEA. It may be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the provision of support services.
11.2 By submitting your personal data to Fish Fight, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
12 CHANGES TO OUR PRIVACY POLICY
12.1 We may make any change to this Privacy Policy at any time by sending you an email with the modified terms or by posting a copy of them on Fish Fight. Any changes will take effect seven (7) days after the date of our email or the date on which we post the modified terms on Fish Fight, whichever is the earlier. Your continued use of Fish Fight after that period means that you agree to be bound by the modified terms.
